Please read these Terms of Use (“Terms”) carefully before using the website located at www.gaipeds.com (the “Site”), operated by Greater Atlanta Integrative Pediatrics (“GAIP,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and GAIP. Your continued use of the Site constitutes ongoing acceptance of these Terms, including any updates we may make. We reserve the right to modify these Terms at any time; changes are effective upon posting to the Site with an updated “Last Updated” date.

2. Who We Are

Greater Atlanta Integrative Pediatrics is a licensed pediatric medical practice located in Roswell, Georgia. Our Site is intended for informational and patient-support purposes for parents, legal guardians, and prospective patients. The Site is not directed to children under the age of 13.

3. Not Medical Advice

IMPORTANT: The content on this Site — including text, graphics, images, blog posts, FAQs, and any other materials — is provided for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment, and should not be used as a substitute for professional medical advice from a licensed healthcare provider.

Always seek the guidance of your child’s physician or qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Site. If you believe your child is experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

4. Patient Portal

4.1 General Terms

GAIP provides access to a patient portal (“Portal”) hosted by CERBO MD-HQ (gaip.md-hq.com) for registered patients and their authorized guardians. Use of the Portal is subject to these Terms as well as any terms of service imposed by MD-HQ. In the event of a conflict between these Terms and MD-HQ’s terms, MD-HQ’s terms govern with respect to the Portal platform itself.

4.2 Authorized Users

Portal access is limited to:

  • Parents or legal guardians of current GAIP patients
  • Adult patients (18 years or older) of GAIP
  • Individuals expressly authorized in writing by a patient’s legal guardian

You are responsible for maintaining the confidentiality of your Portal login credentials and for all activity that occurs under your account. Notify us immediately at intakes@gaipeds.com if you suspect unauthorized access.

4.3 Appropriate Portal Use

The Portal is designed for routine, non-urgent communication including appointment requests, prescription refill requests, referral inquiries, and general questions. It is not monitored 24/7 and must not be used for:

  • Medical emergencies — call 911
  • Urgent symptoms requiring same-day clinical judgment
  • After-hours urgent concerns — contact Children’s Healthcare of Atlanta Nurse Advice Line at 404-785-KIDS

GAIP will make reasonable efforts to respond to Portal messages within two business days. Response times may vary during holidays or high-volume periods.

4.4 Portal Security

While the Portal uses encryption and access controls to protect your information, no electronic system is entirely secure. You agree to use the Portal only on trusted devices and networks and to log out after each session. GAIP is not liable for unauthorized access resulting from your failure to secure your credentials.

5. Intellectual Property

All content on this Site — including but not limited to text, logos, graphics, icons, images, audio clips, and software — is the property of Greater Atlanta Integrative Pediatrics or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and print materials from the Site solely for your personal, non-commercial use in connection with your child’s care. You may not:

  • Reproduce, distribute, or publicly display Site content without our prior written consent
  • Modify or create derivative works based on Site content
  • Use GAIP’s name, logo, or trademarks without express written permission
  • Scrape, crawl, or systematically download Site content

6. User Conduct

By using this Site, you agree not to:

  • Submit false, misleading, or fraudulent information through any form or the Portal
  • Impersonate any person or entity, or misrepresent your relationship to a patient
  • Attempt to gain unauthorized access to any part of the Site or Portal
  • Use the Site to transmit spam, malware, or any harmful code
  • Interfere with the operation of the Site or its servers
  • Use the Site for any unlawful purpose or in violation of these Terms

GAIP reserves the right to terminate or restrict your access to the Site and Portal at any time for violation of these Terms or for any other reason at our discretion.

7. Third-Party Links and Embedded Content

The Site may contain links to third-party websites or embedded content (such as patient education resources, maps, or telemedicine platforms). These links are provided for convenience only. GAIP does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GAIP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAIP AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR PORTAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall GAIP’s total liability to you for all claims arising out of or relating to these Terms or the Site exceed one hundred dollars ($100.00). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Greater Atlanta Integrative Pediatrics and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of another person or entity.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, available at https://gaipinc.com/privacy-policy, and our Notice of Privacy Practices, which is available upon request. The Privacy Policy is incorporated into these Terms by reference.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia. You consent to the personal jurisdiction of such courts.

Before initiating formal legal proceedings, you agree to contact GAIP in writing at intakes@gaipeds.com to attempt to resolve any dispute informally.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and GAIP regarding your use of the Site and supersede all prior agreements and understandings.
